1. Definitions
In these Terms and Conditions, the following definitions apply:
- "The Company", "we", "us", or "our" refers to Vertex Bodyworks, trading from Unit 4 Drake Court, Riverside Park Industrial Estate, Middlesbrough, TS2 1RS.
- "The Customer", "you", or "your" refers to the individual or organisation commissioning repair work from the Company.
- "Services" refers to all vehicle repair, restoration, bodywork, painting, and related services provided by the Company.
- "Vehicle" refers to the motor vehicle, trailer, or other item presented for repair.
- "Quote" or "Estimate" refers to the price provided by the Company for the proposed work.
2. Acceptance of Terms
By instructing us to carry out any work, you agree to be bound by these Terms and Conditions. These terms apply to all services provided by Vertex Bodyworks unless otherwise agreed in writing.
3. Quotations and Estimates
All quotations are provided based on a visual inspection or photographic assessment of the vehicle. Quotes are valid for 30 days from the date of issue unless otherwise stated. The Company reserves the right to revise a quotation if, upon closer inspection, additional damage or work is identified that was not visible at the time of the original assessment. Any additional costs will be communicated to you and your approval sought before work proceeds.
4. Payment Terms
- A deposit of 50% of the quoted price is required prior to the commencement of work, unless otherwise agreed.
- The remaining balance is due upon completion of the work, before the vehicle is collected or returned to you.
- Payment can be made by bank transfer, credit card, debit card, or cash.
- If payment is not received within 7 days of the work being completed, the Company reserves the right to charge interest at the rate of 8% above the Bank of England base rate, and to exercise a lien over the vehicle until payment is received in full.
- For insurance work, payment terms may differ and will be agreed with the relevant insurer or the customer as applicable.
5. Warranty and Guarantee
- All paintwork repairs carried out by Vertex Bodyworks come with a lifetime guarantee against defects in workmanship, including peeling, flaking, and colour mismatch.
- Alloy wheel repairs carry a 2-year guarantee against defects in workmanship.
- The warranty does not cover damage caused by subsequent accidents, misuse, neglect, improper washing techniques (e.g., automated car washes with brushes), stone chips, environmental damage, or normal wear and tear.
- Warranty claims must be reported to the Company within a reasonable time of discovery. The Company will inspect the area and, if the claim is valid, carry out rectification work at no charge.
- The warranty applies only to the original customer and is non-transferable.
6. Liability
- The Company carries full public liability and motor trade insurance.
- Our liability for any claim arising from the Services shall be limited to the value of the work carried out.
- The Company shall not be liable for any indirect, consequential, or incidental losses, including but not limited to loss of use of the vehicle, loss of earnings, or travel expenses.
- The Company takes reasonable care when working on your vehicle. However, we cannot accept liability for pre-existing defects, rust, or mechanical issues that may become apparent during or after the repair process.
- Where mobile repairs are carried out at your premises, you are responsible for providing a suitable and safe working area. The Company shall not be liable for any damage to property arising from inadequate or unsafe working conditions.
7. Cancellation Policy
- You may cancel or reschedule a booking by providing a minimum of 24 hours' notice before the scheduled appointment.
- If you cancel or fail to attend your appointment with less than 24 hours' notice, the Company reserves the right to charge a cancellation fee of 50% of the quoted repair cost.
- If you cancel after work has already commenced, you will be liable for the cost of all work completed up to the point of cancellation, plus the cost of any materials used.
- The Company reserves the right to cancel or reschedule appointments due to adverse weather conditions (for mobile repairs), equipment failure, or other circumstances beyond our reasonable control. In such cases, we will offer an alternative appointment at the earliest opportunity at no additional cost.
8. Insurance Work
- Where the Company carries out repair work in connection with an insurance claim, you remain responsible for any excess or shortfall in the insurance payout.
- The Customer is responsible for submitting the claim to their insurer. The Company may assist with this process but does not guarantee the outcome of any claim.
- If the insurer does not approve or pay for the full cost of the repair, you are liable for the outstanding balance.
- The Company will only commence insurance repair work once authorisation has been received from the insurer, unless you agree in writing to cover the costs privately should the claim be declined.
9. Customer Responsibilities
- You must ensure the vehicle is presented in a reasonably clean condition in the area(s) to be repaired.
- You must disclose any known defects, prior repairs, or issues with the vehicle that may affect the repair.
- For mobile repairs, you must provide adequate access, space, and lighting for the technician to carry out the work safely. The repair area should be sheltered from adverse weather where possible.
- You must remove all personal belongings and valuables from the vehicle before handing it over for repair. The Company accepts no responsibility for loss of or damage to personal items left in the vehicle.
- You are responsible for ensuring the vehicle is taxed, insured, and roadworthy (where applicable) at the time of collection.
10. Collection and Delivery
Where the vehicle is left at our premises for repair, it is your responsibility to arrange collection within 3 working days of being notified that the work is complete. After this period, the Company may charge a storage fee of £15 per day. Vehicles left uncollected for more than 30 days may be disposed of in accordance with applicable law, and any costs recovered from the proceeds.
11. Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control. This includes, but is not limited to, acts of God, fire, flood, extreme weather, epidemics, pandemics, government actions, supply chain disruptions, strikes, or civil unrest. In such circumstances, the Company will use reasonable endeavours to resume performance as soon as practicable.
12. Intellectual Property
All photographs, videos, and content produced by the Company during or in connection with the repair process remain the property of Vertex Bodyworks. We may use before-and-after images of your vehicle for marketing, social media, and promotional purposes unless you notify us in writing that you do not wish your vehicle to be featured.
13. Complaints
If you are dissatisfied with any aspect of our service, please contact us as soon as possible at contact@vertex-bodyworks.co.uk or by calling 01642 422339. We will aim to acknowledge your complaint within 2 working days and resolve it within 14 working days. If we are unable to resolve the matter to your satisfaction, you may seek independent advice or pursue alternative dispute resolution.
14. Data Protection
We process your personal data in accordance with our Privacy Policy. By accepting these Terms, you acknowledge that you have read and understood our Privacy Policy.
15. Entire Agreement
These Terms and Conditions, together with any quotation or written agreement, constitute the entire agreement between you and the Company in relation to the Services. No variation of these Terms shall be effective unless agreed in writing by the Company.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
